Gangbanger out on bail almost kills innocent mother, kids in shootout: cops

A gangbanger out on bail for a firearms bust allegedly exchanged gunfire with a rival in Manhattan — forcing a family to take cover in their apartment when a stray bullet smashed through their window, police sources said.

Maria Dominguez, 41, and four of her children managed to take cover and escape harm as Joshua Moreno, 20, allegedly fired off the shots at 9:45 p.m. outside their Harlem residence, according to the sources and the woman’s son.

“Once they heard gunshots through the window they just dragged everybody out there,” said 23-year-old Gary Bermejo, who was asleep in the next room at the time of the shooting.

Bermejo described how his mom pounded on his door, panicked that a bullet had shot into the bedroom where she and his four siblings — including 19-year-old sister, two six-month-olds and a two-year-old — had been sitting.

“She was afraid,” Bermejo told The Post. “She was thinking about getting her kids out.”

The bullet sent shards of glass flying across the room, including on a bed, just feet from the children, who “were all crying,” he said.

“They put a bullet through her window. That could’ve been a child. That could’ve been someone innocent,” Bermejo added.

Bermejo said he ran downstairs to tell cops about the horrifying incident.

Sources said that Moreno blasted off six rounds and before running off. Cops managed to soon capture him and found a Jennings .25-caliber pistol that he had allegedly ditched, sources said.

Cops charged him with criminal possession of a firearm and criminal position of a weapon, according to the NYPD.

The other shooting suspect currently remains at large, police said.

Bermejo said that his mother hopes both suspects are brought to justice.

“She was saying that she was happy that one of them was captured, but she would be happier if both of them were captured.”

Just two nights ago, Bermejo said, the family had hosted a birthday party for the two-year-old inside that room. He noted the event could have ended in tragedy had the shooting happened then.

“All the kids were here, and they were in the room playing. And then the next day there were gunshots. So imagine that those two nights landed on the same night… That could’ve been someone’s life right there,” he said.

Moreno, a reputed member of the 3 Staccs” street gang, was busted in the Bronx in February 2020 on criminal possession of a weapon charge, court records show.

A judge set bail at $4,000 and was let out after he partially secured bond, records show.
